Romania’s minister of Justice will be allowed to start disciplinary proceedings against judges and prosecutors in grounded cases, according to a bill drafted by the Government.

Romania's Justice Minister May Start Disciplinary Action Against Judges, Prosecutors - Bill

The draft normative act has been sent to the Parliament to be debated with urgency.

The bill amends the statute of judges and prosecutors and Law 317/2004 regarding the High Council of Magistrates.

According to the bill, disciplinary proceedings against judges may be started by judicial inspectors, the minister of Justice and the president of the High Court of Justice, and in the case of prosecutors by judicial inspectors, the minister of Justice and the prosecutor general, Justice Ministry state secretary Lidia Barac said Wednesday.

She added that, under the current legislation, only disciplinary commissions within the Judicial Inspection may take disciplinary action.

The Judicial Inspection will have legal personality and its own budget.
