The Court of Appeals in December decided it cannot open the trial between Patriciu and SRI, as the information presented by the prosecutors is considered state secret, and the respective court lacks the competence to rule in such matters.
The panel of judges appointed to rule in the trial asked that the Court name another panel of judges certified by the National Register Office of State Secret Information, or ORNIS.
The new panel of judges is to rule whether the respective information can be admitted as evidence in the file.
Mid-February 2007, Patriciu’s lawyers submitted with the Bucharest Court a complaint against the Intelligence Service regarding the illegal tapping of several of Patriciu’s phone calls.
