Romanian Court Suspends PM’s Decision To Sack IT&C Regulator Head – Sources

"Basically, Dan Georgescu can go back to filling the position of president of the communication and information technology regulator,” the sources said.

Prime Minister Calin Tariceanu sacked Georgescu effective August 20, when the decision was published in Romania’s Official Gazette.

According to the normative act, the decision was made based on an internal public audit report drafted in August, which noted the breaching of several stipulations of Government Emergency Ordinance 79/2002 on the general regulatory framework in communications, Government Emergency Ordinance 34/2006 on the attribution of public procurement contracts, Law 53/2003 (Labor Code), Law 672/2002 on internal public audit and Law 500/2002 on public finance.

Georgescu asked the Bucharest Court of Appeals to suspend the prime minister’s decision. Georgescu said the decision dismissing him from the position is not legally grounded and also asked for the suspension of the decision appointing his replacement, Dorin-Liviu Nistoran.

Nistoran, an independent lawmaker, was appointed president of the IT&C regulator on August 20, and the prime minister’s decision appointing him was published in the official Gazette two days later.
