Romanian Light Car Accidents To Be Settled Amiably, No Police Required As Of July ’09

The amiable solution of traffic accidents resulting in mild damage could become operational on July 1, 2009, when the Insurance Surveillance Committee receives approval from the EU for the form on amiable acknowledgement.

"After this approval, (the regulator) will issue a norm regulating amiable acknowledgement in case of light accidents. Later, within 90 days, car insurance companies will conclude a protocol of collaboration. A realistic deadline for the introduction of this procedure would be July 1, 2009," regulator president Angela Toncescu said in a seminar.
 
Toncescu said drivers who have CASCO insurance policies and are involved in traffic accidents which resulted in the damaging of their own vehicle, will be able to ask the insurer, starting with January, 2009, for the literature necessary for the repair of the car, without having to go to the police.
 
This provision is included in Order 12/2008 of the Insurance Surveillance Committee, published in the Official Gazette at the end of July.
 
According to the normative act, insurers will issue for their CASCO clients, on request starting with January 1, 2009, the documents necessary for the repair of vehicles, even for the situation where the car is beyond repair.
 
The insurer will issue the documents for the commencement of repair works on the car when the CASCO policy holder notifies the company on the damages occurred in traffic accidents where the car was damaged, or in circumstances other than traffic accidents.
 
In these two situations, the CASCO holder no longer needs to go to the police, according to the regulator.
 
Accident statements and the documents for the commencement of repairs works on the vehicle will be issued by insurers and will contain the information mentioned in the annexes to Order 12/2008.
 
According to the normative act, the issue of the documents for repairs does not constitute the final technical note on the damages nor a payment obligation for the insurer.
 
According to data from the regulator, the number of CASCO policies valid on June 30 reached some 1.3 million, issued by 26 insurers.
 
In Bucharest, where some one third of the national car park is clustered, in 2007 there were some 73,700 light traffic accidents, according to information supplied by Constantin Stroescu, officer within the Bucharest Traffic Police.
