The measure is applied as of July 1, but only for small accidents involving two cars, Commissioner Paul Toma said.
Drivers involved in fender benders will only have to fill in a form and file it to their insurer, he mentioned.
Amiable settlement is not mandatory and drivers who do not want to settle can always report to the nearest police section, without having to worry about penalties, Toma said.
In addition, the drivers need not to go to their insurer within 24 hours since the accident (like they are required to do if they report the accident to the police) and they cannot be tested for alcohol either.
As long as the police do not write a minute on the fender bender, there can be no legal penalties, Toma mentioned.
Amiable resolutions are regulated by Law 136/1995 on insurance and re-insurance in Romania, Government emergency Ordinance 195/2002 with respect to traffic on public roads and the Order 21/2008 of the Insurance Supervisory Commission applying the norms on the use of accident amiable resolution form.
The parties involved in an accident fill in the form with the circumstances of the event, their personal and vehicle identification data, as well as information on their insurers.
Filling in the form does not constitute an admission of responsibility in the event, but is only a tally of facts which will aid in solving the case.
The amiable resolution procedure is applied for small road accidents between two vehicles on Romanian territory, provided the incident does not result in injuries or casualties.
