Romanian Control Institutions Can’t Check Cos More Often Than Once Every Two Years

Romanian specialized control institutions will be forbidden to verify the activity of firms more than once every two consecutive years unless they have firm grounds to do so, and will be fined between 1,500 lei (EUR1=RON4.0987) and RON2,000 if they infringe the law.

The draft law forbidding specialized control bodies to carry out more than one control every two consecutive years was drawn up by the Economy Ministry and aims at amending Law 252/ 2003 regarding the unitary control registry.

Under current legislation, the institutions assigned to undertake controls in the fiscal and financial sectors, healthcare, urbanism, construction quality, consumer protection, labor protection, labor inspection, protection against fire, as well as other sectors, have the right of control over taxpayers and companies registered with the Trade Registry to see if they observe the law.

Controls are carried out in the presence of the legal representatives of the controlled taxpayers, who must present control bodies with all the documents relevant for the period that undergoes verification.

The draft law aims to eliminate unjustified repeated controls of the same company, so that their activity be less affected by the respective controls they must undergo.

Unjustified repeated controls of the same company will be considered law infringements and will be sanctioned between RON1,5000 and RON2,000.

The initiators of the draft law claim the new law will increase the efficiency of control activities, reduce bureaucracy and corruption.
