Romania Paid EUR10M Damages In 1H 2010 Following ECHR Rulings

The Romanian Government has paid over 43.39 million lei (EUR10.2 million) in damages in the first half of 2010, which were imposed through rulings of the European Court of Human Rights (ECHR), according to an official document.

The amount of damages paid in the first half of 2010 exceeds the total amount paid in 2009 and the overall damages paid in the 1998-2007 interval.

Damages were imposed by the ECHR for breach of citizens’ legal rights by the Romanian state, mainly in cases regarding ownership. Under the law, damages imposed through ECHR rulings are paid within three months since the ECHR ruling becomes final.

The document also includes the situation of damages paid by the Romanian state over the past years, since the ratification of the European Convention on Human Rights.

The amount of damages imposed by the ECHR has increased constantly from RON24,213 in 2000 to RON136,868 in 2001, to RON1.08 million in 2002, RON7.6 million in 2003, RON2.23 million in 2004, RON2.27 million in 2005, RON3.04 million in 2006, RON14.05 million in 2007 and RON47.1 million in 2008.

Mid-July this year, Romanian Justice Minister Catalin Predoiu said most of the cases Romania lost at the ECHR regard the country’s inconsistent jurisprudence when it comes to enforcing laws regulating ownership rights.
