Mailat, 25, allegedly beat and sexually assaulted Giovanna Reggiani near the Tor di Quinto train station in Rome, Italy. The woman, who was savagely beaten, died at a hospital several hours later.
Despite a coroner’s report ruling out rape, Italian judge Claudio Mattioli decided in February to maintain the charge of sexual assault against Mailat, arguing the victim was found with no underwear and her button pants loose.
The judge said that Mailat’s first charge is that of sexual assault, followed by murder and theft.
Although the assault may not have been concluded, evidence shows that Mailat certainly intended to sexually assault the woman.
Giovanna Reggiani’s brutal murder prompted Italian authorities to order expulsion of any European citizen deemed dangerous, for “reasons of public safety.”
