Amended Romanian Labor Code: Burden Of Proof In Work Conflict On Employer

Romania's Labor Ministry has shifted the burden of proof in a work conflict back onto the employer, according to the latest draft of the amended Labor Code, obtained by MEDIAFAX.

A previous draft amendment to the Labor Code required the plaintiff to provide proof of a work conflict, repealing a certain article of the current Code.

The Ministry has undone this amendment; therefore the employer is required to provide evidence in their defense before their first appearance in court.
