Romanian Lawmakers’ Prosecution Approval Procedures Deemed Unconstitutional

Romania’s Constitutional Court deemed unconstitutional Wednesday provisions in the regulations of the Senate and Chamber of Deputies regarding the majority needed to approve prosecution of former or acting government members who are lawmakers.

The Constitutional Court decided article 155 section 3 of the Chamber of Deputies Regulation and article 150 section 3 of the Senate Regulation are unconstitutional and suspended the respective provisions.
 
Article 155 section 3 of the Chamber of Deputies Regulation states that prosecution requests for government members are approved with a two-third majority of all deputies, which goes against the Constitution, which states that ordinary laws and decisions are adopted with a majority of lawmakers present at the plenary meeting of each chamber of Parliament, the Court said in a press release.
 
For the same reason, the Court deemed unconstitutional the provision on the Senate Regulation which stated that prosecution requests for government members are approved with a majority of all senators.
