Under the law, Romania’s prosecutor general is appointed by the head of state, at the proposition of the justice minister, with the consultative approval of the High Council of Magistrates. The prosecutor general is appointed for a three-year term and may be reinstated only once.

The proposition to reinstate Kovesi met with disapproval by the High Council of Magistrates

Kovesi was first appointed general prosecutor of Romania on October 2, 2006, through a presidential decree.
