Romanian Senators Adopt Law Protecting Consumer’s Right To Annul Contract
The Senate adopted, with amendments proposed by senator Florin Mircea Andrei, a legislative proposal to revise the Law on the consumption code, Law 296/2004 and Law 193/2000 regarding abusive clauses in contracts between traders and consumers.
According to the proposal, the parties’ rights to just compensation would not be affected in the case of a unilateral contestation.
Senators amended the list of abusive clauses to include those that obstruct or cancel the consumer’s right to unilaterally contest or annul the contract in case the trader has not fulfilled his/her contractual obligations or has imposed a clause compelling the consumer to pay an amount in the case of unilateral contestation.
The law initiative is pending vote in the Chamber of Deputies, as decisional chamber.
