The Bucharest Court of Appeal approved Tuesday the Greater Romania Party's request to notify the Constitutional Court on the legality of several texts within Government Ordinance no. 66 and 97 in 2008.
Bucharest Court Of Appeals Notifies Constitutional Court On Uninominal Constituency Ordinance
The trial where the far-right Greater Romania Party, or PRM, requests the cancellation of established voting constituencies was suspended.
PRM asked the Bucharest Court of Appeal to notify the Constitutional Court regarding several articles of Ordinances 66 and 96 of 2008.
At the same time, the PRM representative, Lucian Bolcas, again requested the suspension of the Government Decision outlining the uninominal constituencies for the Parliament elections set for November 30.
Bolcas said the Government Decision regarding uninominal constituencies "was issued from a domain prohibited by the Constitution.” He explained the difference between constituencies cannot be greater than 30%, while the Government Decision outlining the constituencies uses the phrase "usually" and is not strictly limited, which causes a violation of the voting equality.
In reply, the Government, represented by law firm Tuca Zbarcea and Associates, said the exceptions of unconstitutionality raised by the Greater Romania Party, namely the unconstitutionality of article 3 of Ordinance 66/2007 and article 1 item 11 of Ordinance 97/2008, are not relevant for the case, as these texts have no impact on the request to cancel the Government Ordinance outlining constituencies.
