Bucharest’s Election Bureau Rejects Remus Cernea's Candidacy For Lawmaker Seat

Bucharest electoral bureau spokesman Iulian Ivan said Law 35/2008 prohibits independent candidates or candidates from parties without Parliament representation from participating in by-elections for a lawmaker seat.

Ivan also said Cernea did not submit with the electoral bureau either the required list of people who back him, or the proof he paid the 3,000 lei (EUR1=RON4.0967) tax as an election guarantee.

Cernea, a candidate in the 2009 presidential elections, filed Monday evening his candidacy for a lawmaker seat in a by-election on April 25.

A lawmaker seat in the Chamber of Deputies, in a constituency of capital Bucharest, has been vacant since early February, when conservative Daniela Popa resigned to accept a position on the board of the country's insurance regulator CSA.

Conservative Liliana Minca, former head of the Romanian Lottery, and TV host Teo Trandafir also submitted their candidacy for a lawmaker. Ivan said their candidacies will be declared final on April 11, after contestation procedures are carries out.

The electoral bureau also rejected early January Cernea's candidacy to the Chamber of Deputies by-elections.

The bureau's decision was challenged with the Bucharest Court which admitted the exception of unconstitutionality of Law 35/2008 raised by Cernea and forwarded the case to the Constitutional Court.

On January 14, the Constitutional Court rejected Cernea's contestation.
