Court Allows New Medical Examination For Romanian Ex General Stanculescu

Stanculescu on Monday presented a medical certificate issued in September 2007, which indicates he suffers from cardiovascular diseases.
 
He requested that the court consider this certificate and suggested the medical examination conducted and sealed by six doctors fails to provide a correct analysis of his diseases.
 
Moreover, the court is to discuss Stanculescu’s request to have his 15-year prison sentence lifted on medical grounds.   
 
Medical examinations previously conducted by the “Mina Minovici” Institute indicated that Stanculescu suffers both from cardiovascular diseases and from chronic leukemia. 
 
Both Stanculescu and Mihai Chitac, sentenced to 15 years in jail each for their role in killing demonstrators during the 1989 anti-communist revolution, previously asked the court to annul the sentence, citing medical problems.
  
On October 15, the Supreme Court sentenced Stanculescu and Chitac to 15 years in jail each. On October 16, Stanculescu’s lawyer, Alice Draghici, filed a request at the Bucharest Military Court to discontinue her client’s jail term, and an appeal for the annulment of the sentence at the High Court of Justice.
 
On October 21, the Bucharest Military Court allowed the former generals’ requests for a medical expertise at the “Mina Minovici” Institute, meant to establish if they can carry out their sentence in prison and subsequently, medical examinations indicated that they suffer from chronic illnesses.  
 
Romania’s Supreme Court decided on November 17 to put off until January 26, 2009 the trial of the appeals of both Stanculescu and Chitac for the annulment of the sentence to 15 years in jail each for their role in the anti-communist revolution.     
 
Chitac and Stanculescu were first sentenced in 1999 on aggravated murder charges for ordering troops to fire on demonstrators in Timisoara city, western Romania.
