Romanian Tax Auth To Foreclose People With Overdue Health Contributions – Bill

The Romanian Senate on Wednesday adopted 61 to three votes and one abstention a normative act empowering the country’s tax authority ANAF to foreclose private individuals who fail to pay contributions to the Social Health Insurance Fund in due time.

Under the draft, failure to pay health insurance contributions in due time shall trigger foreclosure procedures and delay penalties by the tax authority, with a view to collect revenues to the state budget.

The draft also sets the Finance Ministry, via the tax authority, will collect the contributions of legal entities and private individuals, as employers, and of private individuals who gain income other than salary income. The tax authority shall collect these contributions into an open account of the National Health Insurance House.

Democrat liberal senators Serban Radulescu and Iosif Secasan, the initiators of the normative act, said the „numerous impediments” in collecting health insurance contributions require the intervention of the tax authority to collect these contributions through foreclosure procedures. Health insurance contributions will be paid for taxable income obtained from freelance activities, agricultural income subject to the income tax, income obtained from transferring goods into somebody else’ use, income obtained from dividends and interests and intellectual property income.

The Senate was the first chamber notified on the normative act, which amends Law 95/2006 regarding reforms in healthcare.
