Romania’s Court Of Accounts Law Deemed Constitutional

The court debated Wednesday the intimation submitted by 60 deputies on the basis of article 147 letter a of the Constitution of Romania, regarding the unconstitutionality of Law amending Law 94/1992.

The deputies claimed certain constitutional provisions were breached, saying lawmakers adopted the law without considering the president’s request to re-examine the draft law, given that certain texts of the law sent for promulgation were taken out on re-examining the law, while others were introduced although they were not included in the president’s request. 

The court ruled the law is constitutional, as the texts, either taken out or introduced, do not breach the provisions of article 77 section 2 of the Constitution, which states that before promulgating a law, the head of state may ask the Parliament, once, to re-examine the law.

The Court’s decision will be published in the Official Gazette of Romania and the head of state will be informed in this respect to promulgate the law.
