Romania’s State Protocol Buildings Can Be Sold In Direct Negotiation – Senate
The Senate debated the reexamination request for the law approving Government Ordinance no. 28/2007 amending Government Ordinance no.19/2002 regarding the sale of state private property administered by the state protocol authority.
Senators voted 35 to 15 and ten abstentions the report of the committee for legal matters on the president’s reexamination request. Senators decided RA-APPS buildings can be sold by direct negotiation with tenants.
Basescu argued that auctions should be the sole sale method, as it is the best guarantee that the sale involved no foul play and it would be the only way for the public to have access to the respective buildings.
Basescu added tenants could have a preference right only if their offer matches that of other potential buyers.
However, senators did enact two amendments to the law, stipulating that tenants would be asked for a written point of view regarding the sale of the building by direct negotiation and if the tenant does not express a stand or does not opt for direct negotiation, the building would be put up for sale in a public auction.
The final decision in this mater belongs to the Chamber of Deputies.
