The European Commission will present the report on justice in Romania, which, according to EU sources, will refer to the leadership of he High Council of the Magistrates and will state that the National Anticorruption Department is on the right track as far as investigations go.

The report will also mention that the National Integrity Agency is still not functional.

According to UE sources, the report, which will be enacted and presented by the European Commission, will also refer to the amendments introduced in the Criminal Procedure Code and will underline delays in the appointment of judges and prosecutors. In addition, the document will mention that further progress is needed in the fight against corruption on a local level.

According to the quoted sources, the European Commission will avoid commenting any particular case, but it will point out that certain procedures trigger delays in institutions.

The report also contains some positive evaluations regarding dialogue with the Government and it will not mention the potential activation of the safeguard clause, mostly targeting facts.

In addition, the Commission does not wish to get involved in debates and speculation and it does not intend to take political sides.

To avoid getting involved in the internal situation, the Commission will not comment on the absence of a justice minister, but this situation could have been seen as a sign of lack of progress at one point. Also, the report will underline the fact that the Commission expects the legal human resources strategy for 2009 and it will mention the Government’s strategy against corruption, EU sources said.
