The Court annulled on Wednesday the government decision grating a land, public property of the state, to the Tennis Foundation "Academia Ilie Nastase."
EXCLUSIVE: Romanian Tennis Player Ilie Nastase Losses Land In Court
The Bucharest Court of Appeals admitted the exception regarding the illegality of Government Decision no. 946/1999 and annulled government decision no. 311 of March 8, 2006 that approved giving a land, from the administration of the National Sport Agency, to be used free of charge by the tennis foundation "Academia Ilie Nastase."
The Government had granted the 64,000 square meters land, situated in the northern part of Bucharest, to be used for free by the foundation for a 60-year period. However, a government decision from 1999 stipulated that the legal deadline to lease the land was of only 49 years.
The Court’s decision can be appealed in 15 days.
Government decision of 1999, leased the land to Ilie Nastase, founder of the "Academia Ilie Năstase" institution, for a 49 year period. Radu Vasile, Prime Minister at the time, signed the decision.
According to article no. 11 from Law no. 219/1998 regarding the lease legal status, amended though Law no. 219/1998, a land cannot be leased but for a period of 49 years. Consequently, the 60-year period stipulated in government decision no. 311 is an illegal one.
