The decision can be appealed with the nine judge section within the High Court of Justice.
Late October, the lawyers of Nastase and Ioan Melinescu, former head of the money laundering prevention authority, raised exceptions of unconstitutionality and claimed the criminal probe against the two was null.
Nastase said he could go as far as to notify the European Court of Human Rights if the situation is not solved under Romanian law.
End May, Nastase and Melinescu were indicted in a case involving the transfer of money by one Tamara Cernasov to the account of Nastase’s wife, Dana Nastase.
The former prime minister is charged with bribery, while Melinescu is charged with bribe taking, concealing or destruction of documents and disclosure of information.
