Individuals Crossing Romanian Border Without Declaring EUR10,000 To Face Prison – Draft

Individuals crossing the Romanian border without declaring amounts equal to or greater than EUR10,000 will be charged with a crime and imprisoned for two to seven years, according to the draft Government Emergency Ordinance aiming to fight tax evasion.

Under current legislation, the punishment is a fine and the seizure of the money. The draft ordinance keeps the provisions regarding seizure, but adds a harsher punishment.

The document also says that the transit of goods subject to special regulations without their inspection by border authorities shall be considered smuggling. The same provisions will apply in case of the collection, possession, production, transport, carrying, storage, delivery or sale of goods subject to special regulations, which are known to originate from smuggling or are to be used for this purpose.

The draft ordinance also provides a penalty between six months and three years in prison for individuals who attempt to prevent judicial police and fiscal authorities from searching transporters for special status goods.

Authorities will also develop a joint database on contraventions in the field of border control, to be administered by the Ministry of Administration and Interior.
