The decision is not final and can be appealed within five days. The decree will be suspended until a previous challenge made by Romania's Defense Ministry against the act will be solved.
The ministry previously filed an administrative challenge against the decree, requesting its suspension and annulment.
President Klaus Iohannis issued a decree on December 28 extending the term of Gen. Ciuca for another year, after he refused the nomination made by Defense Minister Gabriel Les for the office.
However, the defense minister criticized the decision and stated that term extensions from the office must follow the same procedure as new appointments – they must be proposed by the minister, with approval from the country’s prime minister.
