Romanian Finance, Environment Ministries OKed Car Tax Refund Procedure

The procedure to refund the difference between the tripled car pollution tax, valid between December 15, 2008 and February 19, 2009, and the one enforced between July 1 and December 15, 2008, has been approved through an order of the Romanian Ministers of Finance and of the Environment.

The order, published Thursday in the Official Journal, states that the amount to be refunded is to be decided by the fiscal body to which the taxpayer is registered.

According to the law, the resolution term for refund requests is 45 days as of the registration of the request at the appropriate fiscal body. Should this term be exceeded, taxpayers have a right to interest as of the day following the expiration of the term. The interest will be paid out of the budget of the Environment Fund.

The vehicle’s identification card, registration and a receipt or account statement proving the payment of the tripled tax must be annexed to the refund request. In the case of vehicles purchased abroad, the person requesting the refund must enclose a document certifying the date of the first registration.

People who bought their vehicle before December 15 and registered them afterwards will be able to benefit from this refund, if they provide evidence that the purchase was made before that date.

As of February 19, 2009, Romania’s car pollution tax is a third lower than the tax valid between December 15, 2008 and February 19, 2009, but is twice as high as the tax valid between July 1 and December 15, 2008.
