Romanian Pres Accounts For Decree Banning Cumulated Pensions And Wages In Public Sector

Romanian President Traian Basescu said Thursday that the “famous decree” banning pensioners hired in the public sector from receiving both pensions and salaries, observes the Constitution, adding it only targets to wipe out "any misuse of state funds."

Basescu highlighted the decree does not target companions of people with disabilities or actors, adding the decree only aims to wipe out any misuse of state funds.
 
Romania’s Ombudsman Ioan Muraru appealed the decree at the Constitutional Court, citing infringement of constitutional principles and the retroactive status of the decree. Muraru pointed out that the decree cannot work retroactively, prior to its enactment.
 
Norica Nicolai, vice-president of the National Liberal Party (PNL), told a press conference Thursday that the liberals urged Muraru to notify the Constitutional Court on the unconstitutionality of the decree.
 
Romanian Prime Minister Emil Boc said Wednesday that teachers, doctors and actors who are pensioners can earn other state incomes based on a social convention that pays them divided by items and not in the form of a salary, for the activities performed in public institutions.
 
However, retired teachers and doctors who are still working in the public sector can get both types of income based on a social convention, while actors may be paid according to the copyright law, but any payment cannot take the form of a salary.
