In the case Konolos v. Romania, the Court found that there had been a violation of Article 5 of the European Convention on Human Rights.
Gheorghe Konolos, age 43, was remanded in custody in January 2000 on suspicion of deception, tax evasion, forgery and making use of forgeries. Relying on Article 5 § 1 (right to liberty and security), he complained that his pre-trial detention between April and August 2002 had been unlawful.
The Court considered that during the period in question the applicant’s detention had not been based on any valid domestic decision or any other “lawful” basis for the purposes of Article 5 § 1.
