The reexamination request reads that the law regulating the public-private partnership, which was sent to the Parliament for approval, refers to the norms concerning public-private partnership projects.
According to the reexamination request, the Government emergency decree regulating public procurement contracts, public work concession contracts and service concession contracts translated into the country’s legislation two EC directives regulating public procurement, namely Directive 2004/18/EC and Directive 2004/17/EC, creating thus a more comprehensive public procurement legislation.
The president also calls attention to irregularities in the public-private partnership law and urges lawmakers to eliminate them as they breach certain EEC norms. The head of state stressed that replacing auctions with selection and negotiation procedures threaten contract awarding transparency.
