Romania’s Draft Constitution: Preventive Detention Extended To 48 Hours

Preventive detention will be extended to 48 hours from 24 hours, according to a bill revising the Romanian Constitution, published Wednesday by the Presidential Administration.

Under the current fundamental law, preventive detention cannot exceed 24 hours.

President Traian Basescu on Wednesday sent the bill revising the Constitution to the Legislative Council for a standpoint.

After the council issues a standpoint on the bill, the draft act will be sent to the Constitutional Court, which will check whether it is constitutional.

The bill, together with the standpoint of the Legislative Council and the decision of the Constitutional Court, will be forwarded to the Parliament to be debated and put to the vote.
