Early July, Basescu asked the Parliament to reexamine the law, but lawmakers rejected his proposed amendments. Under the Constitution, the president may challenge the law at the Constitutional Court.
The deputies claimed certain constitutional provisions were breached, saying lawmakers adopted the law without considering the president’s request to re-examine the draft law, given that certain texts of the law sent for promulgation were taken out on re-examining the law, while others were introduced although they were not included in the president’s request.
The court ruled the law is constitutional, as the texts, either taken out or introduced, do not breach the provisions of article 77 section 2 of the Constitution, which states that before promulgating a law, the head of state may ask the Parliament, once, to reexamine the law.
