Romania’s Disputed Car Tax Could Be Amended Late January - Fin Min

The draft ordinance amending laws on Romania’s car tax regime has been largely completed and they new provisions could be adopted end January, finance minister Varujan Vosganian said Thursday.

"By and large, we’ve completed the draft ordinance. The European Commission has been notified of our intentions and the philosophy we presented in June is maintained. The tax will be correlated with the car’s market value," Vosganian said.

Asked by journalists whether there is any possibility for the government to give the money back to taxpayers, Vosganian said there is no final court decision obliging the state to return any of the money paid until now.

"Any discussion regarding a refund of the tax will be based on a decision of the European Commission and final and irrevocable court rulings," Vosganian said.

The first registration tax for cars was introduced early this year, with the elimination of excises on imported cars and cars bought off the domestic market. The tax is calculated depending on engine capacity, car age and level of emissions.

The European Union has opened an infringement procedure on Romania for its car tax regime, and could take the matter up with the European Court of Justice, feeling the tax is unjustified.
