Romania’s Pres Asks Justice Min To Probe High Ranking Officials

Basescu told Melescanu to start criminal investigation against Adrian Nastase, former prime minister between 2000 and 2004, Miron Mitrea, former transportation minister between 2000-2004, former justice minister Tudor Chiuariu, acting labor minister Paul Pacuraru, acting IT&C minister Zsolt Nagy, politician Victor Babiuc, former economy minister Codrut Seres and former agriculture minister Traian Decebal Remes.

The Constitutional Court unanimously ruled, at the end of November 2007, that dispositions of article 16 from Law no. 115/1999 regarding ministerial liability and those of government emergency ordinance no. 95/2007 amending Law no. 115/1999 regarding ministerial liabilities are unconstitutional.

Following the Court’s decision, the Special Presidential Commission approving the criminal investigation against current and former ministers was declared unconstitutional.

According to article 109, section 2 from the Constitution, only the Chamber of Deputies, the Senate and Romania’s president are entitled to request the criminal investigation against Government members for deeds committed during their activity.

If a member of the Government is sent to court, than they are automatically suspended from their position.  Only the Supreme Court has the competence to rule on such matters.
