Romanian Constitutional Court Says CNSAS Is Not Disbanded

The Romanian Constitutional Court states that the unconstitutional tag placed on the Law governing the Romanian authority for the study of Securitate archives, CNSAS, does not disband the institution, but if the law is not amended within 45 days, its provisions will no longer be effective.

Through Decision 51 on January 31, 2008, the Constitutional Court stated that justice is the only one that can render “verdicts” regarding deeds against human rights, according to a press release issued by the Press Office within the Court.

Disregard for this principle represents a serious violation of human rights and the rule of law, the quoted source adds.

Decision 51 on January 31, 2008 does not repeal Law 187/1999 and it does not disband CNSAS. According to article 147 paragraph (1) of the Constitution, the law is suspended over a period of 45 days, during which period CNSAS cannot exercise its legally set competences.

If there are no amendments to the law before this deadline, the mentioned provisions cease to be effective.
