The Romanian Ombudsman called on the Constitutional Court to analyze the legality of Government Emergency Ordinance 94/2009 on the reorganization of certain Government bodies.
The ordinance was adopted to amend the Law approving Government Emergency Ordinance 3/2009, which dissolved the Antifraud Department. It also transferred the Antifraud Department to the Government's work apparatus, under the direct management of the prime minister and coordinated by the deputy prime minister. The normative act required staff to sign loyalty commitments and set that hiring would be based on the prime minister's confidence in the applicant.
The Constitutional Court in July ruled unconstitutional the law approving Government Emergency Ordinance no. 3/2009. The Court said at the time that its provisions breached the Labor Code, the principle of equality of rights and the right to work.
