The Romanian Government will push a draft law banning the cumulation of pension with salary in the public sector, a normative act to be debated with urgency in Parliament, Prime Minister Emil Boc announced.

"The government is determined to push on, to end this circus with public money. What shall we do? The Court rejected the ordinance because of its form, saying the government does not have the right to issue ordinances in such matters. This basically means we can go on with a draft law subject to the approval of the Parliament, which is what we will do," Boc said.
He added the draft law will be approved in a future government meeting and it will be sent to Parliament to be debated with urgency.
The Romanian Constitutional Court decided Thursday, with a majority of votes, that the provisions of Government Emergency Ordinance 230/2008, banning cumulated pensions and wages in the public sector, are unconstitutional, thus allowing the exception raised by the ombudsman.
The Constitutional Court allowed the exception raised by the ombudsman, stating that Government Emergency Ordinance 230/2008 is unconstitutional because it violates the fundamental rights mentioned in the Constitution regarding the right to labor and the right to pension, namely it goes against article 115 section 6 of the fundamental law.
"We have been informed of the Court’s decision. Even if I find it hard to accept and understand the reasons behind the Court’s decision, the decision will be respected. It is natural in a rule of law. However, it remains my belief that the ordinance issued by the government does not reject the right to labor, it simply contains the abusive spending of public money," Boc said.
