Romanian President Calls For Reexamination Of Magistrates’ Statute

Romanian President Traian Basescu sent the Parliament Friday a request for the reexamination of amendments to the law on the statute of judges and prosecutors, saying that the European Commission would file a negative report if magistrates are allowed to occupy positions without a contest.

The request was sent to the Chamber of Deputies speaker Roberta Anastase, the president’s office said in a statement. Basescu asked lawmakers to reconsider the elimination of contests and interviews required to fill positions of judges and prosecutors and the acceptance in such positions of people who have served as magistrates for at least ten years but had their activity interrupted.

"Since the European Commission, in its interim report of February 4, 2008 regarding Romania’s progress within the Cooperation and Verification Mechanism, criticized the old regulation that allowed magistrates to fill positions without a prior contest, reintroducing that possibility might attract negative consequences in the country report due in July 2009," the head of state said in the reexamination request.
