According to prosecutors, between April 12, 2002 and May 2002, social democrat Mihailescu received nine hunting guns from Fanel Pavalache, worth a total 26,400 lei (EUR1=RON4.1246) after he had appointed Pavalache adviser through Order no. 352/2001. Between April and October 2002, Mihailescu held the respective guns illegally, stored at a protocol villa in Snagov, near capital city Bucharest.

Prosecutors ordered that the assets deemed illicit gains be seized.

On April 14, 2008, the Supreme Court decided to send the file back to anticorruption prosecutors to rebuild the case, after it took note of the Constitutional Court ruling which said Mihailescu rejoiced immunity stemming from his former position of coordinating minister.

On July 31, 2008, Romania's prosecutor general requested the Senate set off procedures and approve the opening of a criminal investigation against Mihailescu.

On June 10, 2009, the Senate adopted Decision no. 8/2009 whereby it requested Mihailescu's prosecution.
