Romanian University “Spiru Haret” Allowed To Admit Students For ’09-’10 School Year

Basically, the court partially allowed the suspension of article 6, section (2), note 1, of Annex 3, within Government Decision HG 749, as well as the suspension of article 7.

According to article 6, section (1), the new majors authorized to function temporarily included in the current decision have the right to unfold activity starting with year I of school year 2009-2010, while section (2) states that for the majors/academic programs no longer included in the current decision, no admission contests will be organized starting with school year 2009-2010.

Article 7, section (1), shows that legally acknowledged higher education institutions can organize admission contests, the education process, graduation exams, can issue diplomas and other academic documents exclusively in the locations approved by the Romanian Agency Insuring the Quality of Higher Education and solely for the majors/academic programs authorized for temporary functioning or acknowledged separately for each form of education (daytime, reduced frequency, long distance learning), approved through Government decisions, with a statement of the location. (2) Violation of the provisions of section (1) leads to a voiding by the Ministry of Education, Research and Innovation of the studies and academic documents issued by these institutions.

The court ruled "Spiru Haret" University is to pay legal expenses worth 7,500 lei (EUR1=RON4.2116).

The "Spiru Haret" University sued the Ministry of Education and the Government for promoting Government decision 749/2009 removing the institution from the list of acknowledged universities and banning the organization of student admission contests for school year 2009-2010.

University representatives demanded the temporary suspension of the Government Decision until the trial of the annulment request, set for October.
