EU Received No Formal Notice On Romania CO2 Lawsuit

The European Commission received no formal notification regarding Romania’s legal action over its carbon dioxide national allocation plan for 2008-2012, a spokesperson of EU commissioner for environment, Stavros Dimas, said Tuesday.

On December 21, 2007, Romania filed a lawsuit against European Commission’s decision to cut the country’s carbon dioxide limits by 20%.

EU spokesperson said Romania had no obligation to notify EC on its intention to file a lawsuit.

Asked whether EU had talks with Romanian authorities to solve the issue without legal actions, the spokesperson said EC consults the states, in accordance with the current procedures, but EC decision stays in force.

In October, the European Commission slashed Romania’s proposed emissions cap by 20.7% to an average allowance of 75.9 million tons per year for the next five years. The commission also cut by 10% Romania’s emissions limit for 2007.

The Romanian businessmen’s representatives said back then that EC decision was a “discretionary” one, triggering EUR2 billion losses to thermal plants, and asked the government to take action.
