Romanian Amended Ministers’ Liability Law Unconstitutional

The Romanian Constitutional Court decided Tuesday the law amending the law on ministers’ liability is unconstitutional, as the variant adopted by the Chamber of Deputies includes significant changes of the draft initiated by the Government and adopted by the Senate.

The Constitutional Court deemed the law unconstitutional unanimously.
 
"The Constitutional Court, unanimously, found the law is unconstitutional as the variant adopted by the Chamber of Deputies (the decisional chamber) includes significant changes from the draft initiated by the Government, submitted for debates and adopted by the Senate (first chamber notified). This breached constitutional norms regarding the lawmaking procedure, namely the constitutional principle of the two-chamber parliament system and the attributions set for each chamber,” the Court said.
 
The decision is final and generally mandatory and is communicated to the head of state, the chairmen of the two chambers of parliament and the Prime Minister.
