Romania’s Public Ministry Defends Judiciaries’ Prerogatives

In the light of recent amendments to both the criminal procedure code and the criminal code, Romania’s Public Ministry informed Thursday the Ministry of Justice that these amendments simply restrain the prerogatives of the judiciaries affecting their activity.

According to prosecutors, the amendments to the criminal procedure code enable the person under investigation to destroy or conceal the evidence.
Prosecutors said that the amendment regarding the minimum 24-hour deadline necessary for the ex-officio lawyer to prepare the defense "actually invites culprits and defendants to hinder the trial."
Based on this amendment, if the ex-officio lawyer fails to show up within the 24-hour deadline during which the culprit is detained, then, the temporary arrest measure expires and the culprit is free to walk, the Public Ministry pointed out.
