Romanian Senate Chairman Mircea Geoana on Wednesday challenged the education law, arguing that its adoption through a vote of confidence in the Government was unconstitutional, but also contesting its content.

In his complaint to the Constitutional Court, Geoana, a social democrat and member of the opposition, says the education bill was adopted despite having been sent back to the Government on November 30, through a decision by the Parliament's Standing Bureaus.
Geoana also argues that its adoption through a vote of confidence was unconstitutional. He said that the Court's previous decisions have made it clear that the Government may not use the confidence procedure any time it feels that the Parliament is not debating or adopting a bill as quickly as the Executive would want, or whenever debates in the legislature are moving into a direction the Government does not want.
As regards the education bill currently in the Senate, Geoana said it will continue on its course. The bill is being debated by the Senate's committee for education matters, having been sent back by the plenum, on the Government's request.
The deputies of two opposition parties, the Social Democratic Party and the Liberal Party, have also filed a request with the Constitutional Court on Wednesday concerning the education law, as adopted through the vote of confidence.
