Telephone harassment cases are punishable under Romania’s revised Criminal Code by up to six months in prison or fines, “provided the law violation does not constitute a more serious crime.”
Phone Harassment In Romania Punishable By Up To 6 Months In Jail
Under article 2006 of Romanian Criminal Code, offenses with the intent to harass, annoy, alarm, abuse, torment or embarrass by telephone or writing are punishable with imprisonment between 3 to 6 months or fines.
The Code introduced the telephone harassment crime to “respond to several cases where various individuals – particularly women – are stalked in the street or other public places, or are tormented by telephone messages or by similar words of conduct with the intent to create a state of fear or worrying for the individual.”
International laws already incriminate telephone harassment and the Romanian authorities followed the models of the French Penal Code (article 222-16), Swiss Penal Code (§ 390a C.), Norway Penal Code, as well as the English laws (particularly Public Order Act 1986 and Protection from Harassment Act 1997)
The draft Criminal Code was approved last week, along the Criminal Procedure Code, Civil Procedure Code and the draft Civil Code.
Romanian government plans to assume responsibility over the new Codes in May.
